Most people dream about buying real estate in a sunny, tropical location with sea breezes and a slower pace of life. Mexico definitely fits that bill.
But buying real estate in a foreign nation can be challenging. For instance, in Mexico, there is something called the Fideicomiso (pronounced fi-dei-co-mi-so), which is a bank trust that allows foreigners to buy property in Mexico.
Our clients typically have a lot of questions regarding the Fideicomiso in Mexico, so we thought we’d answer some of the most common ones here for you now.
A: When the Mexican constitution was written, it specifically prohibited any foreign investor to buy land within 62 miles of any national border or within 31 miles of the ocean. Fast forward to the 1970s, when more people began flocking to Mexico on holiday. Many of these people naturally wanted to buy vacation homes here.
To be able to generate this revenue and, at the same time, sidestep the constitution, the Mexican government created a new type of trust called a Fideicomiso.
A Fideicomiso is a 50-year perpetually renewable and transferable Bank Trust that allows foreigners absolute ownership rights to property in Mexico. Technically the bank holds the legal title of the property but grants the foreign buyer all rights of the ownership. It’s a neat little workaround that lets anyone from anywhere buy their dream home here in paradise!
A: In our experience, it’s better to go with a smaller bank. Generally speaking, the Fideicomiso is not a big part of big banks’ business and so may not be a priority. Smaller banks tend to give you more personalized service.
A: Payments are due once appear and can be made directly at the bank. If you do not live in Mexico full time, you can speak to your bank about wiring the payment. If you have a property manager, you can also speak to them about making the payment on your behalf.
A: Sometimes events occur that require you to make changes to your Fideicomiso. You may end one relationship and enter another, or there may be a death of a benefactor. Depending on the particular scenario, there will be certain official steps that will need to be taken.
